Text For Citation: 01 Item/Group: 001A Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. A. Hank's Plumbing & Heating Co. worksite located at the intersection of Detroit Ave. & Glendale Ave., Toledo, Ohio: On or about December 17, 2013, the employer did not prohibit employees from riding the bucket of the John Deere 690 E LC hydraulic excavator in/out of the excavation which was approximately 13 feet deep exposing the employee to fall or struck by hazards from an inadvertent operation and movement, as observed on December 17, 2013. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow requirements outlined in the John Deere 690 E LC Operators Manual, Construction Industry Manufacturers Association Safety Manual for Hydraulic Excavators and the Association of Equipment Manufacturers Safety Manual for Hydraulic Excavators (May 2005) .
