OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazardous atmospheres while working in a permit required confined space: a) On or about 9/11/2013, Canastota Waste Water Treatment Facility: Employee performing welding and cutting operations inside of a "Methane Collection Dome" was exposed to a hazardous atmosphere caused by Methane gas. Among other methods, a feasible abatement method to correct this hazard is to comply with American National Standards Institute ANSI/ASSE Z117.1-2009 ,Safety Requirements for Confined Spaces. Including, but not limited to: 1) Provide a confined space survey as referenced in Section 3.1 2) Provide a hazard evaluation as referenced in Section 3.3 3) Implement a written confined space program as referenced in Section 3.6 4) Provide training and verification including, but not limited to use of meters, retrieval systems, and contents of the confined space program as referenced in Section 15 5) Conduct atmospheric testing prior to entry into the confined space as referenced in Section 6.1 Abatement Documentation is required for this item.
