29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part: a) Job Site - The employer had not developed or implement a safety and health program as evidenced by noted hazards such as but not limited to; employees not using personal protective equipment while handling and using brick mortar that contained Portland Cement, employees near a mortar mixer with an unguarded belt and pulley, and using a gasoline operated mortar mixture without having a portable fire extinguisher, on or about 07/18/13. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
