Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee involved in surveying activities in the center of the intersection and exposed to the hazard of being struck by vehicles. a) Fairview and Cole Road, middle of intersection; On or about May 31, 2013, the employer did not provide traffic control/protection for an employee performing surveying activities in the middle of an active high volume intersection to locate the survey marker in the morning. b) Fairview and Cole Road, middle of intersection; On or about May 31, 2013, the employer did not provide traffic control/protection for an employee performing surveying activities in the middle of an active high volume intersection to uncover the survey marker later in the afternoon.
