OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards which could result in broken bones and/or possible death when they were elevated to heights ranging from 6 to 12 feet on the forks of powered industrial trucks. a) Warehouse - On or about February 27, 2013, where materials are retrieved from pallet racking, employees who were not standing on an approved work-platform were lifted on the forks of Yale and Toyota Forklifts. Nor were employees provided with adequate fall protection, such as a full body harness and lanyard. Among other methods, feasible and acceptable means to correct these hazards are to ensure that employees are elevated on work-platforms which meet the requirements of the American National Standards/Industrial Truck Standards Development Foundation (ANSI/ITSDF) Safety Standard for Low Lift and High Lift Truck, ANSI/ITSDF B56.1 2005: 1) Section 4.17.2(c): Whenever a truck is used to elevate personnel, the following precautions for the protection of the personnel shall be taken: Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyards, or deceleration devices, etc., are in place and properly used. 2) Section 4.17.3: Whenever a truck is equipped with a work platform, the following additional precautions shall be taken for the protection of personnel: (a) Provide a platform that complies with the requirements in paragraph 7.37.3. and; (b) The platform attachment means are applies and the platform is securely attached to the lifting carriage or forks.
