29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about January 10, 2013 - at the above addressed jobsite, employees were lifting large farming equipment using a fabricated lifting device which is attached to the forks of a SKYTRAK 8042 Rough Terrain Forklift. This practice could affect the capacity of the equipment and the manufacturers written approval was not obtained, thereby exposing the employees to a struck by hazards due to forklift tip over.
