OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm: a) Jobsite: Philadelphia Refinery, Maintenance Garage Department, 3144 West Passyunk Avenue, Philadelphia, Pa 19145- On August 23, 2012, Respondent Sunoco, Inc., exposed an employee to the recognized hazard of being run over and crushed by a truck during a servicing operation. Respondent Sunoco, Inc. failed to ensure that all employees stayed clear of the vehicle while its braking system was being tested. The employee was lying on the ground underneath the truck, behind the passenger side rear tire. Another employee started up the truck, which unexpectedly lurched backward, crushing and killing the employee.
