Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that there was no functional seatbelt provided on the John Deere compact utility tractor. (a)Outdoors, North of the Bag House, on the concrete pad - On or about October 6, 2011, employees operating the John Deere Model 1070 compact utility tractor, with a Model 440 front-end bucket and Roll Over Protective Structure/Falling Object Protective Structure attached, because the female-half of the seatbelt was broken and could not fasten. Among other methods, one feasible and acceptable abatement method to correct this hazard is to purchase a replacement seatbelt half and install it.
