Text For Citation: 01 Item/Group: 001A Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by rock and the hazards associated with vibration of the body: Location: 500 Town Green Drive Elmsford NY 10523 On or about 8/9/11, a) An employee operating a crushing machine was exposed to the hazard of being struck by rocks and to hazards to the body associated with vibration because he was operating the crusher while standing on a maintenance platform. One feasible and acceptable method to correct these hazards is to follow the Manufacturer's User Manual and not allow operators to operate the machine from maintenance platforms. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
