Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injury or death by standing on the midrail of a scissors lift work platform: a)Jobsite: On March 3, 2010, and times prior thereto, employees were exposed to serious injury or death by standing on the midrail of the scissors lift work platform to elevate them high enough to install an extended eave section on a metal building. Note 1: Among other methods, one feasible and acceptable means of abatement would be for the employer to follow the American National Standard for Self-Propelled Elevating Work Platforms (ANSI A92.6-1999) that requires: Chapter 8.9 - Operator Warnings and Instructions, Paragraph 8.10.9. Personnel shall maintain firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited. Note 2: Abatement certification and documentation is required for this item.
