Text For Citation: 01 Item/Group: 001A Hazard: CUTS
Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure that employees were not exposed to recognized hazards that were likely to cause death or serious physical harm as follows: a.At the Fontainbleau structure, on the 7th floor, an employee used a Spray Tech EPX 2355 Piston pump unit to apply fire rated mastic CP 672 coating onto the top of the ceiling and wall area(s). The spray pump unit was equipped with a pressurized spray gun that was capable of producing a fluid stream of 3100 p.s.i.. While performing the job task, employee #1 failed to engage the trigger lock prior to passing the spray gun to employee #2. Employee #2 was sprayed on the right forearm and received skin abrasions from the pressurized fluid stream that was released from the spray gun. After interviews with both employees, it was determined that they were not familiar with the "Operators Manual" nor the use of the trigger lock on the spray gun. Employees were exposed to serious injury and possible amputation. Reference: Spray Tech EPX 2355 Piston Pump manual: 1. Page 2, paragraph 5, Prevention of Injection Injury, item 13: Always engage the trigger lock when not spraying. Verify the trigger lock is functioning properly. One feasible means of abatement would be to ensure that the operator read the Owners Manual to ensure proper operation of the unit and be aware of the safety hazards that the Owners Manual refers to, to include any safety features the operator should be aware of.
