Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, and other fire hazards from spouts that throw material that were not as dust tight as practicable when in use: (a) For the employees working in the area of the remelt room where sugar dust was dispensed into the air and the electrical equipment in the room was not rated for the classified area, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the NFPA 61, National Fire Protection Association - Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Products Facilities, Section 7.3.7, including, but not limited to, ensuring that spouts are as dust tight as practicable.
