Text For Citation: 01 Item/Group: 001A Hazard: UNAPEQUIP
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being ejected from the forklift truck or being thrown forward in case of an accident with other vehicles or fixed objects: OR IN THE ALTERNATIVE 29 CFR 1917.43(b)(1): Modifications that might affect the powered industrial trucks capacity or safety were performed without either the manufacturer's prior written approval, or the written approval of a professional engineer experienced with the equipment who had consulted with the manufacturer: (a)Port of Pago Pago, American Samoa - On or about October 31, 2008 and at times prior thereto, the Taylor forklift truck (Model # TE-30M/Serial # S-HS-19443) had the manufacturer installed seatbelt removed. AMONG OTHER METHODS, ONE ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO INSTALL A SEAT BELT. THIS FORKLIFT TRUCK WAS ORIGINALLY DESIGNED WITH A SEAT BELT.
