Text For Citation: 01 Item/Group: 001A Hazard: LACKTRAIN
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential hazard of overloading the crane: (a)StarKist Dock Area - On or about October 27, 2008 and at times prior thereto, the crane operators for cranes 3, 5 and 7 did not know how to read a load chart. The employer never administered a practical examination to crane operators to ensure that they understand how to read and interpret load charts. AMONG OTHER METHODS, ONE ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO ADMINISTER A PRACTICAL TEST TO OPERATORS AS SPECIFIED IN SECTION 5-3.1.2 AMERICAN NATIONAL STANDARDS INSTITUTE, B30.5-1968, SAFETY CODE FOR CRAWLER, LOCOMOTIVE AND TRUCK CRANES. OR IN THE ALTERNATIVE 29 CFR 1910.180(b)(3): The employer did not ensure only designated personnel were permitted to operate a crane covered by this section: (a)StarKist Dock Area - On or about October 27, 2008 and at times prior thereto, the employer allowed personnel to operate mobile cranes that were not qualified or trained to read and interpret load charts. NOTE: 29 CFR 1910.180(a)(21) defines designated as a person selected or assigned by the employer or the employer's representative as being qualified to perform specific duties. One critical qualification of a crane operator is the ability to read and interpret load charts.
