Text For Citation: 01 Item/Group: 001A Hazard: UNAPOPPROC
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: North side of the building; on or about October 20, 2008, employees operated an aerial manlift to reach elevated portions of the building being painted; the aerial manlift was not being operated in accordance with the aerial manlift manufacturer instructions as the manlift axles were not extended prior to the platform being raised. This exposed the employees to the hazard of the aerial manlift tipping over. The aerial manlift did tip over resulting in the death of an employee. Among other methods, one feasible and useful method of abatement would be to assure that all aerial manlift operators utilize the aerial manlift per the manufacturer's instruction, both in the operator manual and posted decals.
