Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries: a) On or about March 23, 2009 and times prior, an employee operating a fork truck was not wearing a seat belt exposing him to serious injuries in the event of a tip-over or other accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are trained regarding the hazards associated with not wearing seat belts and to implement an active, effective enforcement policy.
