Section 5(a)(1) of the OSH Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that operators of amusement park rides were exposed to the hazard of being struck by amusement park rides when they enter areas inside of ride barriers or other methods of guarding: a) 800 Ocean Terrace, Seaside Heights, NJ 08751: Operators of amusement park rides were exposed to the hazard of being struck by amusement park rides when they enter areas inside of ride barriers or other methods of guarding. On or about July 15, 2008. Among other feasible methods, the following methods of abatement would eliminate or materially reduce the hazard cited: (i)Institute formal policies and procedures to ensure that rides are not operating at such time that ride barriers or other methods of guarding are bypassed and provide formal instruction to operators regarding the same. The policies and procedures must clearly detail how rides will be kept inoperative while employees are in hazardous areas. (ii)Provide formal training to all employees re: procedure for bypassing barriers or other guarding methods. (iii)Advise patrons, through posting, as to procedure for retrieval of property dropped or lost in track locations.
