Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crane collapse due to loads being unstable. On or about January 22, 2010, employees working on the ground and/or on the roof were exposed to struck-by hazards due to a possible crane collapse. The employer using a National truck mounted crane was lifting buckets of gravel with riggers fully extended sitting on broken wooden pads. The employer did not ensure that the pads to which the outriggers were placed were in good condition to prevent an unstable load and/or to prevent the crane not being uniformly loaded. One feasible and acceptable abatement method to correct this hazard includes but is not limited to: replacing the wooden pads and to inspect them on a regular basis. Keeping the pads in good condition will keep the loads even and stable when outriggers are to be used.
