Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and crushing injuries from the tip-over or failure of a scaffold platform: a) On or about July 18, 2008, and at times prior thereto, employee(s) performed framing activities from a fabricated wood scaffold platform approximately 24 feet wide and supported by a Gehl DL8H rough terrain forklift. The platform extended beyond the wheels approximately 7 to 8 feet on each side and deflected downward towards the ends. Note 1) Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a work platform that is constructed in accordance with the design criteria of Section 8.24.1(b) of ASME B56.6-2002 Safety Standard for Rough Terrain Forklift Trucks. Note 2) Abatement certification is required for this item.
