Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the back end of the excavator cab when it swung to move a load: a)228 Underhill Avenue, West Harrison, NY: The employee working within the swing radius of the Komatsu PC200LC-7, Serial Number 253289, was exposed to the hazard of being struck by the back end of the cab; on or about 6/11/08. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is as follows: 1. Follow the Komatsu Operation and Maintenance Manual PC200LC-7L, Page 1-3, Safety Labels, Paragraph 2 states: "To prevent SEVERE INJURY or DEATH, do the following before moving the machine or its attachments: Honk horn to alert people nearby; Be sure no one is on or near machine in the swing area; Rotate cab for full view of travel path if it can be done safely; Use spotter if view is obstructed. 2. Follow the Komatsu Operation and Maintenance Manual PC200LC-7L, Page 1-15, Section entitled "Ensuring Good Visibility" states: "Check for any persons or obstacles in the area around the machine and check conditions of the jobsite to ensure that operations and travel can be carried out safely. 3. Follow the Komatsu Operation and Maintenance Manual PC200LC-7, Page 1-17, Section entitled "Safety Rules for Changing Machine Directions" states: "If there is an area to the rear of the machine which cannot be seen, position a signal person. Take special care not to hit other machines or people when turning or swinging the machine." 4. Follow the Komatsu Operation and Maintenance Manual PC200LC-7L, Page 2-95: SWINGING - WARNING! The rear of the machine extends outside the track width. Check that the surrounding area is safe before swinging the upper structure."
