Text For Citation: 01 Item/Group: 001A Hazard: FALLING
Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The creating, correcting and exposing employer failed to ensure the Al-speed shoring frame was used in accordance to manufacture's procedures, as follows: a.The 24th story of the Newport Lofts Condominiums under construction, three employees were instructed to dismantle a 35 feet Al-speed shoring frame and use the space frame as an anchor point to tie off from. Three employees were working on the Al-speed shoring frame when a wind gust of more than 46 mph hit the shoring and caused it to collapse to the deck. Employees were exposed to 35 foot fall to the deck. Two employees were transported to UMC. One of the employees was released after he was examined. He sustained minor injuries. The other employee sustained three (3) fractured vertebra. The employer failed to follow the manufacturer requirements as listed below: 1.Erect, dismantle or alter shoring only under the supervision of a qualified person. 2.Use shoring equipment only for the purposes or in ways for which it was intended. 3.Do not use shoring systems for fall protection. One feasible means of abatement is to follow the Manufacturer's Operating instructions.
