Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious harm to employees in that, employees were exposed to crushing injuries while operating a fork-truck unsafely contrary to the Owner/Operator Pre-Operative Instruction Manual: a) On or about September 7, 2007, the employer did not ensure that employees were protected from crushing injuries while using a fork-truck (Lull, Model 644B, Serial #J3U4Nll-3155) improperly to lift a hydro-mobile scaffold. The following items in the Owner/Operator Pre-Operative Instruction Manual were not implemented: 1) The fork-truck controls were operated from outside the cab. 2) The load was lifted by using one fork. 3) The load was lifted outside the fork-truck's center of gravity. 4) The load was lifted where the surface was not level. 5) The operator did not approach the load squarely. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to follow the Owner/Operator Pre-Operative Instruction Manual.
