Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: a. On or about November 28, 2006 and at other times thereto, in the Tank Wash area, employees were exposed to fire hazards when flammable vapor, from a tanker(s) that previously contained gasoline, a Class I flammable liquid, was purged into the work area. Among other methods, one feasible method to control exposure to these hazards include, but is not limited to the following: Develop and implement written procedures for the degassing of tank trucks containing flammable and combustible materials to eliminate the hazards associated with this operation.
