Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a vehicle: a.On or about October 19, 2007, the KOMATSU WA500-6 wheel loader was being used in weather conditions that greatly reduced the operator's visibility. Among other methods, one feasible and acceptable abatement method is to follow the operator's manual for the KOMATSU WA500-6 on page 1-19, where it states to "stop operations if there is poor visibility", under the section labeled ENSURE GOOD VISIBILITY.
