Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a.On or about February 6, 2007, the employer did not follow the manufacturer's guidelines to appoint a crew member to help guide the driver of the Tuckerbilt T-630 equipment and to check the clearance before swinging the trough, exposing employees to being struck or crushed by the equipment. Among other methods, one feasible and acceptable abatement method to correct the hazard is to ensure to follow the manufacturer's instructions to appoint one crew member to help guide and check the operator's clearance before moving the machine or swinging the trough. ABATEMENT CERTIFICATION IS REQUIRED.TION
