Text For Citation: 01 Item/Group: 001A Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by motor vehicles: On or about July 11, 2007 at a work place located on State Highway 110, New Summerfield, TX; the employer by not redirecting traffic around the work area exposed at least six employees, who were working in open lanes of traffic while removing temporary pavement markings (yellow tape) from the center of the roadway, to the hazards of being struck-by a motor vehicle. Among other methods, one feasible means of abatement includes but is not limited to complying with Section 6C.05, Transition Area, of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000.
