Text For Citation: 01 Item/Group: 001A Hazard: CRUSHING
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Being crushed by a forklift in the event of a roll over, due to the lack of the employees wearing seatbelts. In the warehouse area and shipping/receiving area, employees were observed not wearing seatbelts when operating the Clark and Toyota forklifts. If a rollover occurred, an employee could try to leave the forklift or be tossed from the operator's seat, and be crushed by the forklift. Reference: ASME B56.1-1993, revision of ASME/ANSI B56.1-1988, paragraph 5.3.19 - An active operator protection device or system, when provided, shall be used. Operator protection in the event of tip over is intended to reduce the risk of entrapment of the head and torso between the truck and the ground. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to require and ensure that employees use the seatbelts on the forklifts.
