North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls from the bed of a truck: a)site - where two employees were exposed to falls of more than 8 feet while leveling construction debris, including broken concrete, drywall, paper and lumber, being loaded into the bed of a Ford F650 Dump Truck. There were no protective rails on the sides and back of the truck bed. ABATEMENT NOTE: Among other methods, employees could be protected by a railing around the truck bed by installing vertical extensions in/over the walls of the existing bed rail with attached horizontal railing; or a work policy which removes employees from the bed of the truck when a fall protection system is not used.m
