Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by the roll-over protective structure on this machine due to the absence of a functioning seat belt: (a)Opposite #152 Old Jackson Road, north of Gluckstadt, Mississippi - On or about March 28, 2007, an employee was operating the Waldon Sweep Master road sweeper, Model 250, S/N 27436-010, while not wearing a seat belt. The female- receiver-buckle and other half of the seat belt were missing from under the left side of the operator's seat on this machine. Among other methods, one feasible and acceptable abatement method to correct this hazard is to order and install the missing half of the seat-belt and buckle, and to ensure that the operator restraint system is worn.
