Text For Citation: 01 Item/Group: 001A Hazard: FALLING
Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling from the moving tractor-mounted box- blade attachment, and being fatally injured. (a)Northside Drive at Cascades Circle West workzone, Clinton, Mississippi - On or about September 8, 2006 at 12:35 PM, a Mississippi Paving & Construction, Inc. employee was observed riding atop the box-blade attachment mounted on the rear of the New Holland 345D Turbo-charged diesel tractor, which was being driven passed the street intersection mentioned above at a high rate of speed. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce a policy of not allowing any riders on moving equipment, except for authorized employee(s).
