Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a.On or about July 27, 2005, the rough terrain forklift operator left the vehicle unattended while a worker was on the elevated platform. The operator was not at the controls while one employee was elevated on a work platform approximately 12 feet high. This constituted a hazard of the lift shifting, or of the employee falling, or the lift being struck by objects or other hazards, and no way for the employee to get down. Among other methods, a feasible and acceptable method to correct this hazard is to have the operator remain at the controls while any employee is elevated on platform. ABATEMENT CERTIFICATION IS REQUIRED.TION
