Text For Citation: 01 Item/Group: 001A Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 11 feet while opening and closing the gate of the load out spout: (A)Job Site: On March 14, 2005, and at times prior thereto, employees were exposed to a fall hazard of approximately 11 feet while standing on the forks of a Clark, model C500 HY45, serial number HY355 222 2827 forklift to open and close the gate of the load out spout. ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst others, install a chain on the gate so that the gate can be opened from the ground, thereby eliminating the need for a worker to be elevated to the level of the gate. Note: Abatement certification is required for this item.
