Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by or crushed by while dismantling a 100 foot, American Crawler Crane, Model 4250, Serial #GS114655, boom without securing it from dropping or without the use of a service crane, on or about 05/10/05, at 2117 East X St., Deer Park, TX. Among other methods,one feasible and acceptable abatement method to correct this hazard is to (1) support or secure the boom against falling as specified by The American Society of Mechanical Engineers (ASME) B30.5 - 1968.
