Text For Citation: 01 Item/Group: 001A Hazard: STRUCK BY
Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 11/21/04, in front of 1705 SE Sailfish Point Blvd., three employees were exposed to the hazard of being struck by motor vehicles because they were not wearing high visibility vests while performing an unloading operation in the road as required in Section 6D.03 paragraph B of the Manual on Uniform Traffic Control Devices (MUTCD). Among other methods of abatement, one feasible and acceptable method to correct this hazard is to provide high visibility vests to employees working in the road as referenced in the Manual on Uniform Traffic Control Devices (MUTCD). IN THE ALTERNATIVE 29 CFR 132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about 11/21/04, in front of 1705 SE Sailfish Point Blvd., three employees were exposed to a struck by hazard due to the lack of reflective vests.
