KRS 338.031(1)(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.The employees were using the bucket of a Komatsu PC 300LC excavator to gain entry into and to exit from an open excavation approximately twenty-one feet (21') deep located at 1719 Wiswell Road, Murray, Kentucky. The employer did not furnish a place of employment which was free from recognized hazards such as falling from the bucket of the excavator or being struck or crushed during a cave-in of the excavation walls which were not adequately protected. A feasible and useful means of abatement would have been to provide cave-in protection for the entire depth of the excavation and to provide access ladders.
