North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by an unsecured load on an improperly loaded truck: a)site - on or about 09/11/03, employees were exposed to unsecured aluminum panels weighing 1,080 pounds being transported on a makeshift platform outside the confines of the cargo compartment of a 1989 Dodge Dakota, 1/4 ton pickup truck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a transport vehicle appropriate for the weight and size of the material involved, and additionally, secure the material in the cargo compartment of the vehicle.
