Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) An employee of Kot Construction was using a job made single cleat ladder with a width of 24 inches. ANSI A 14.4-1979, 4.3 requires single cleat ladders have a width at least 16 inches but not more than 20 inches. b) An employee of Kot Construction was using a job made single cleat ladder that did not have filler blocks installed under each rung. ANSI A 14.4-1979, 4.5.2 requires that filler blocks of the same thickness as the cleats be inserted between cleats and be butted tightly against the underside of each cleat. No abatement certification or documentation is required for this item.
