Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that are causing or likely to cause death or serious physical harm to employees who were exposed to the hazard of being crushed-by a forklift during a tip-over event while operating powered industrial truck at Techtronic without wearing seatbelt. The employer violated this section of the Act on or about April 20,2004, when Clark forklift was operated without a seatbelt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the powered industrial truck has an operable seatbelt and employees are trained to wear the seatbelt.
