***Certification AND Documentation of Abatement Required*** Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by/caught between the counter weights of the revolving superstructure of the 1993, LS 2800 excavator, serial # dll30442, and the carrier on the date of 08/25/04 at the location of 6305 Selinsky, Houston, TX, because the employees were not trained to stay a certain distance from the swing radius or the swing radius was not barricaded. Among other methods,one feasible and acceptable abatement method is to: (1) Implement the measures provided in the Safety Manual for Hydraulic Excavators published by the Construction Industry Manufactures Association as follows: barricade the rear and sides of the swing pivot area to prevent entry and be sure that everyone is clear before moving or swinging in any direction.
