Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating a powered industrial truck without wearing seatbelts: (A)Yard: On or about August 4, 2004, and at times prior thereto, the employer failed to ensure powered industrial truck operators wore seat belts. Three forklift operators were observed not wearing seatbelts. Note: Abatement certification required for this item.
