Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed in the event of a tipover: (a)On or about 18 MAR 03 and at times prior thereto, employees who drove forklifts throughout the facility were not wearing seatbelts nor were they required to. Note: Abatement certification required for this item. Note2: One feasible means of abatement, among others, is to ensure seatbelt are functioning on each powered industrial truck and to enforce the use of seatbelts on all forklifts that should be equipped with them.
