T.C.A 50-3-105(1); ref. ANSI Z245.1-1984.7.1.14.2: An external audible warning signal device conforming to ANSI/SAE J994b, type A, B, or C was not provided to actuate (1) when the vehicle is operated in reverse, or (2) when top-hinged tailgates are open. An example is this fatality case wherein the victim was crushed as a result of the rear loading garbage collection vehicle backing up unexpectedly as the driver was not aware that the truck was in reverse gear. In that the back-up alarm was inoperative. Feasible abatement would be to test all safety equipment prior to each use on the rear loading garbage collection vehicle. This includes testing the back-up alarm.
