North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite; four seasons apartments, springview drive - employees removing gutters came into contact with overhead power lines. NOTE: One feasible and acceptable means of abatement is to have the power lines deenergized before removing the gutters. OR IN THE ALTERNATIVE: CFR 1910.333(c)(3)(i)Unqualified persons(a)when an unqualified person is working in an elevated position near overhead power lines, the location shall be such that the person and the longest conductive object he or she may contact cannot come closer to any unguarded, energized overhead line than the following distancs: (1) for voltages to ground 50 kv or below - 10 feet (305cm)
