Text For Citation: 01 Item/Group: 001A Hazard: FALLING
Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) 110' fall hazard. At 7:10 AM on 02/25/02 on the north side of 12601 Fair Lakes Circle, Fairfax, Virginia, the prime contractor allowed an employee of the sub contractor to use a Sky Genie brand lowering device in lieu of a boatswains' chair to power wash the building and windows which resulted in an employee falling 110' feet and breaking his leg. Lowering devices are classified as prohibited equipment under paragraph 11.3 of ASME/ANSI A39.1a-1987, Safety Requirements For Window Cleaning. "One feasible and acceptable abatement method, among others, to correct this hazard is to use an approved boatswains' chair or suspension scaffold to power wash the windows and side of the building."
