Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a falling hazard from elevated forks of forklift truck: (a)Construction Site, Tatum Rd. Middle School, Hattiesburg, MS - On June 24, 1999, employee was working standing on the elevated fork of Cat. TH63 and did not have a personnel platform with a guardrail system or personal fall arrest system. Among other methods, one feasible and acceptable method to correct this hazard is to provide a personnel platform which has the required restrianing means such as railings, chains, cable, body harness(es) with lanyard(s), etc., in place and properly used. These requirements are set forth in ANSI/ASME B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks, Part II, Par.5.15, Elevating Personnel.
