Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to carbon monoxide which significantly raised the the carboxyhemoglobin concentration levels in the blood of the employee(s): Location: Freezer area. Violation: On October 29, 1999 an employee was exposed to an average workplace carbon monoxide concentration of 703.3 ppm for 188 minutes (this concentration is 3.5 times the VOSHA 5 minute ceiling limit). This corresponds to an employee 8 hour Time Weighted Average exposure of 275.5 ppm (7.9 times the VOSHA permissible exposure limit for carbon monoxide). The exposure determination was based on the carboxyhemoglobin concentration in the blood of that employee. The source of the carbon monoxide was a propane powered Toyota lift truck (Model# 5FGC15; Truck# 75). Among other methods, one feasible and accectable method to correct this violation is to use an electric powered lift truck or to retrofit a propane powered lift truck with a catalytic converter.
