Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a falling hazard from elevated wood platform: (a)Construction Site, Wild Rose Furniture Co., Iuka, MS. - On August 28, 1998, five employees were being elevated approximately 25 feet in the air while standing on roofing material which was loaded on a wooden pallet which was rested on the forks of a Koehring Skytrak Rough Terrain Forklift Truck, Model #9038. The employees were not utilizing a guardrail system or a personal fall arrest system. Among other methods, one feasible and acceptable method to correct this hazard is to provide a personnel platform which has the required restraining means such as railings, chains, cable, body harnesse(s) with lanyard(s), etc., in place and properly used. These requirements are set forth in ANSI/ASME B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks, Part II, Par. 5.15, Elevating Personnel.
