Text For Citation: 01 Item/Group: 001A Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious fall hazards while operating the Mark Industries M20ST scissor lift on a loading dock which was in poor condition. This exposed them to the possibility of the lift overturning while elevated. Among other methods, feasible and acceptable abatement methods to correct these hazards are to use a lift which is designed to be used on rough terrain or to use a boom-type aerial lift operated from ground level. (a) Jobsite: On or about March 12, 1997, employees involved in powerwashing operations were exposed to serious fall hazards while operating the Mark Industries M20ST scissor lift on a loading dock which had numerous depressions, cracks, and bumps.
