29 CFR 1926.95(c)(1): Design and selection. Employers must ensure that all personal protective equipment is of safe design and construction for the work to be performed. (a) On or about November 12, 2025, an employee injury occurred due to the employer not providing employees with hand protection, such as gloves, that would protect an employee's hands and arms from severe burns caused by a spill of hot liquid asphalt sealant (approximately 350 deg F) which occurred during the AC process to seal the edges of new asphalt to another surface. The employer provided wrist length leather or PVC dipped gloves that were not thermally rated or fitted to prevent hot asphalt from running into the glove.
