29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a). a. On or about July 8, 2025, at the above-mentioned jobsite, the employer failed to ensure that employees wearing 3M full-face tight fitting respirators were medically evaluated prior to conducting demolition operations using handheld power chipping tools on a building facade , thereby exposing employees to the hazards associated with respirator use. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
